Court Allowed to Continue Case Against NFL for Discrimination Against Black Coaches

New York — The NFL may bring civil suits against it related to the discrimination of Brian Flores and other Black coaches. On Thursday, the federal appeals court upheld a ruling, dismissing the league's attempt to force Flores to proceed to arbitration under the supervision of Commissioner Roger Goodell.

The Second Circuit Court of Appeals in Manhattan affirmed the ruling of Judge Valerie Caproni, which allows Flores to continue his lawsuits against the league and three teams: "Denver Broncos", "New York Giants", and "Houston Texans".

In the ruling, written by Judge Jose A. Cabranes, the court stated that the arbitration rules of the NFL, which compel Flores to submit his claims to Goodell, do not have protection under federal law for arbitration, as they "only ensure arbitration by name".

The Second Circuit noted that the provisions about arbitration in the NFL constitution "do not provide for an independent arbitration forum, bilateral resolution of disputes, and procedures".

NFL spokesperson Brian McCarthy expressed disagreement with the court's ruling and stated that they plan to appeal it.

In the summer of 2022, Flores filed a lawsuit against the league and several teams, asserting that the league "is permeated with racism", particularly regarding the hiring and promotion of Black coaches. Following the lawsuit, two more coaches were added to the lawsuit.

Flores mentioned that he believes it is risky to file lawsuits, but he believes this is worth it for future generations in the fight against systemic racism in the league. Currently, he is the coordinator for the "Minnesota Vikings."
