Along with the lawsuit, Cruz and Fialko assert that Prescilla profited financially from the downfall of Elvis after the death of Lisa Marie, who passed away on January 12, 2023, at the age of 54 due to complications from a small intestine obstruction. They claim that Prescilla "took advantage of the tragedy" in Lisa's life, disregarding her desire to continue treatment.

This court case has been ongoing since 2023, when Prescilla filed a lawsuit against her business partners for breach of contract. In response, Cruz and Fialko assert that Prescilla abused her position, attempting to control Elvis's decline and the family's assets.
