In NAIROBI, Kenya — The UK government is set to pay millions in sterling pounds to Kenyans for the regulation of civil claims following the military's loss of its legal immunity in Kenya.

The payment amounting to 2.9 million sterling pounds ($3.9 million) is compensation for the damage caused by the forest fire that resulted from an accidental discharge involving British soldiers in 2021. This follows a historical decision that removed the UK government and the British Army's immunity from civil claims in Kenya.

The lawsuit was filed by over 7,700 Kenyans and an ecological group against the British Army, which is accused of destroying over 12,000 acres of forest in the Lolldaiga region. The fire, which was ignited by a training soldier, lasted nearly two weeks, resulting in the death of one person and significant wildlife damage.

Local residents reported health issues due to toxic smoke emissions, which triggered respiratory complications and problems with vision. An ecological assessment indicated that for ecosystem recovery, it would take between 30 to 50 years.

The British government initially stated that there was no liability in Kenyan courts, but this was simply a simplified ruling by the High Court of Justice in the UK, which noted that Britain had incurred absolute liability following the signing of an agreement with Kenya.

A representative of the Lolldaiga community, Kelvin Kubai, affirmed the agreement, stating that it establishes a precedent for future claims and reinforces the accountability of diplomatic and military structures in the partner countries.

However, many residents expressed strong disappointment regarding the compensation amount, stating that it is inadequate compared to the demand of 575 million sterling pounds. Some residents received only 129 sterling pounds, which caused outrage.

Some communities plan to protest for demands of transparency and fairness. Community member John Kiundjuri stated that they will not hesitate to convene for discussions on further actions.

Currently, the British Army is facing new allegations regarding violations of the ban on sexual conduct. Along with the report from the Ministry of Defense, some soldiers continue to engage in transactional sex, despite the ban. Investigations have revealed that these activities persist, regardless of the training and control measures in place.

In addition, the High Court of the UK has ordered the release of contact information for 11 British soldiers, who are reportedly the fathers of children born to Kenyan women during their service. This could lead to new cases regarding paternity, community demands, and compensation.

Despite the military cooperation agreement between Kenya and the UK, it is subject to increased scrutiny due to allegations of violations requiring a review of the military agreement.

Kenya and the UK signed a cooperation agreement on recruitment in 2015, allowing approximately 3,000 British soldiers to undergo training in Kenya annually.
