Attorneys for former special counsel Jack Smith reacted to the notification about the investigation being conducted by the Office of Special Counsel. They described the reasons for the investigation as both baseless and politically motivated.
Regarding the investigation, which was initiated by Republican Senator Tom Cotton, Attorney Smith stated that he is "entitled to a presumption of innocence and to be treated as 'innocent until proven guilty.'" In their response, attorneys Smith, Lanny Breuer, and Peter Koski emphasized that their client's actions as a special counsel adhered to ethical norms and were based on facts, rather than political implications.
The Office of Special Counsel, which is distinct from the position of special counsel in the Department of Justice, confirmed that Smith's investigation is related to possible violations of the Hatch Act. Cotton accused Smith of trying to influence the presidential election in 2024, leading the case against former President Donald Trump.
Smith's attorneys noted that no court ruling prevents the prosecutor from investigating criminal actions of former government officials or candidates in the presidency. They also pointed out that the investigation of the Office of Special Counsel is unusual, especially since this office typically does not deal with the oversight of federal prosecutors.
It is noted that Jack Smith was appointed special counsel in the Biden administration and issued accusations against Trump in cases related to attempts to overturn the results of the 2020 elections and the illegal retention of classified documents.
