Hungary Challenges EU Decision Regarding Aid to Ukraine

The Hungarian government has filed a lawsuit with the European Union Court, seeking to challenge the decision regarding the use of revenues from frozen Russian assets for financing aid to Ukraine. This decision was made without consultation with Budapest, reports the financial newspaper Portfolio.

The lawsuit, filed in July, demands the annulment of the EU Council's decision, adopted in June 2024, which allowed funding military aid to Ukraine from taxes on revenues from frozen Russian assets.

Hungary blocked the approval of payments from the European Peace Facility for a total of more than €6 billion. However, Hungary abstained from voting during the approval of the decision on payments from assets, which allowed the EU to claim that the decision was made with Hungary's consent, while Hungary's position does not matter.

The Orbán government demands to recognize the invalid decision, adopted in December 2025, which was agreed upon for the use of revenues from Russian assets for Ukraine's needs. This document stipulates that Hungary's voice should not be taken into account when adopting decisions on the allocation of specific funds to Ukraine.

However, Budapest asserts that the procedure violates the fundamental principles of legality in adopting decisions, enshrined in the foundational treaties of the EU.

The prospects of Hungary's lawsuit are currently uncertain. Proceedings in the EU Court may take years. In addition, the procedure for the use of revenues from EU assets has already been changed, and part of these funds will be transferred to Ukraine for new purposes, so it is not entirely clear that the court will rule positively.

From the beginning of 2025, the European Union will transfer €10.1 billion to Ukraine as part of the G7 initiative to accelerate revenues for Ukraine (ERA). This initiative includes the allocation of $50 billion to Ukraine by G7 countries, of which the EU will contribute €18.1 billion ($20 billion). Funding will be carried out from frozen Russian assets — namely, from revenues from Russian funds, frozen in European banks.

In July, the Ukrainian state budget received €1 billion from the European Union as part of this program. The previous tranche of this amount was received in June.
