The Situation of Alina Habba in the Office of the U.S. Attorney General Raises Legal Questions

Alina Habba continues to hold the position of U.S. Attorney in New Jersey, despite attempts by some judges to replace her. She was appointed to this position in February 2025, but her term ended without confirmation from the Senate.
After the federal panel of judges did not extend her term, they appointed her successor, Desiree Lee Grace, to this position. However, the Trump administration dismissed Grace on the same day she was appointed, and confirmed that Habba would remain in the position, becoming a legal maneuver.
Two defendants in narcotics cases, Julian Giraud-young and Julian Giraud-senior, have contested the legality of Habba's appointment. They argue that her appointment violates the Vacancies Reform Act, as her nomination to the position of attorney was submitted to the Senate, which prevents her from fulfilling the duties of a U.S. attorney.
The court in New Jersey suspended the case of Giraud-young, transferring the review to a court in Pennsylvania for the determination of the legality of Habba's appointment. Giraud's attorney, Thomas Mirilano, stated that his goal is to ensure a fair judicial process for his client.
Habba, who was previously a personal attorney for Trump, has been involved in many controversial cases, but does not have experience in prosecutorial activities. If she remains in the position, she could fulfill her duties for another 210 days under the law.
