The court in Honolulu dismissed the lawsuit regarding the unlawful death, filed by the widow of an unarmed Black man who was shot by police in 2021. The lawsuit concerned the killing of Lindani Myeni, which occurred on April 14, 2021, and drew international attention, including human rights activists.
Lindani Myeni, a 29-year-old man from South Africa, had recently moved to Hawaii. Authorities reported that he was behaving strangely and without an invitation entered someone else's home, prompting the tourist to call the police. Myeni had previously assaulted a human rights attorney, as a result of which one of them received injuries to the face and a bruise on the chest.
The police employed other measures, including using a taser, which did not affect Myeni. Ultimately, one of the officers shot the man three times, although he continued to attack even after receiving the gunfire in the chest.
Local attorneys requested to dismiss the case for $1.5 million to regulate the matter, but it was not approved by the city council and was transferred to the court. The court process began on July 14, and the testimonies included the widow of Myeni, Lindani's spouse.
The court ruled that the dismissal of the lawsuit was justified since there was no evidence that the officers acted with the intent to cause harm. According to the report about the incident, Myeni suffered from degenerative brain damage, known as chronic traumatic encephalopathy, which can only be diagnosed post-mortem.
