Defendant in the murder case of Tupac Shakur filed an appeal to the Nevada Supreme Court

LOS ANGELES — The man accused of the murder of rap icon Tupac Shakur in Las Vegas in 1996 has filed an appeal to the Nevada Supreme Court seeking the dismissal of the indictment.

Dwayne "Keffe D" Davis filed the appeal last week after a lower court affirmed his indictment. Davis, the only person ever charged in the murder of Shakur, was arrested in August 2023. Other contemporaneous suspects have already passed away.

The 62-year-old man admitted in an interview and in his 2019 memoir that he provided the gun used during the shooting.

Davis's attorney, Karl Arnold, asserts that his constitutional rights are being violated.

"Mr. Davis has cooperated with law enforcement agencies for over a decade, including on prior submissions, and his testimony will not be used against him in any subsequent submissions — rather, this same testimony is now the basis of the state's case," Arnold stated in a statement.

He first filed a motion regarding the dismissal of the case in January of this year, asserting constitutional violations due to a 27-year delay in prosecution. Arnold also noted that Davis had immunity agreements with federal and local authorities.

The surrounding court confirmed his indictment, stating that he was not protected from prosecution, as he did not provide evidence of those immunity agreements, and that the indictment was not malicious.

According to the appeal, Davis was questioned in 1998 and 1999 by federal prosecutors under an agreement that his testimony would not be used against him for his prosecution. At that time, he denied knowing who was involved in Shakur's murder.

He was again questioned in 2008 and 2009 under the same conditions as earlier. It was during that time he described his "foreseen involvement in the murder" and indicated the foreseen shooter.

Arnold noted that the prosecutors did not provide any evidence linking Davis to the murder, other than his own testimonies, which are not sufficient for the court. He urged the Nevada Supreme Court to either satisfy their motion regarding the dismissal of the case or recognize that he had been granted immunity from prosecution for the testimonies he provided during questioning.

Davis remains in custody in the Clark County jail. His court process is scheduled for early February 2026.

The death of Shakur at 25 occurred at a time when his fourth studio album "All Eyez on Me" was still charting, with approximately 5 million copies sold. Shakur, who was nominated six times for a Grammy, is considered one of the most influential and universal rappers of all time.
