On July 31, 2025, Kansas City, Missouri — Supreme Court Justice Brett Kavanaugh defended the court's approach to the increasing number of immigration cases that come from the Trump administration. He responded to criticism that the court does not explain its rulings.
During Trump's presidency, his lawyers often turned to the court when lower courts blocked his executive actions, including harsh immigration policies and attempts to dismiss federal employees. These cases are reviewed through a so-called "shadow docket" of the court, where decisions are made quickly, often in favor of the government, without full arguments or oral hearings.
Kavanaugh, speaking at a conference, noted that the Supreme Court is seriously addressing these cases and aims to provide them with due attention. He stressed the importance of not allowing misunderstandings to arise, stating that the previous assessment of legal issues is an essential word.
The court also mentioned that the Supreme Court conducted oral hearings and issued detailed rulings when it limited bans that blocked Trump's plan regarding citizenship rights by birth. He also recalled cases related to COVID-19 vaccination mandates that emerged during Biden's administration.
Kavanaugh stressed the importance of an independent judiciary, referring to it as "the cornerstone of our constitutional democracy." He expressed gratitude to the judges for their role in upholding the rule of law, noting that criticism is an inevitable part of their work.
