Temporary status for nearly 7,000 individuals from Nepal was set to expire on September 5, while protection for 51,000 Hondurans and over 3,000 Nicaraguans was set to end on August 8. The Secretary of Homeland Security, Kirstjen Nielsen, indicated that the conditions in their home countries no longer require protection.

Judge Trina L. Thompson in San Francisco stated that the plaintiffs provided evidence that the government's decision to terminate the status was racially motivated, and upheld the complaint of the National TPS Alliance, which asserts that these terminations were unlawful.

The TPS judicial practice allows the U.S. government to grant temporary status to individuals from countries where there are conditions that jeopardize their safe return, such as natural disasters or political instability. The Trump administration actively sought to terminate this protection for many groups of migrants.
