Among the plaintiffs are not only the newspaper but also two former students, who point out that due to the fear of losing their visas, they self-censor and refrain from performing tasks related to the war in Gaza. The lawsuit argues two key provisions of the law: one grants the Secretary of State the authority to deport individuals whom he believes may pose a threat to important foreign policy interests of the U.S. The other provision allows the Secretary to, at any moment, unilaterally evaluate a visa.

Advocates state that the actions of the Trump administration have led to the newspaper receiving numerous requests from legal residents of the U.S. asking to remove their names and quotes from publication. Many international students have ceased communicating with journalists, and some authors have requested to withdraw their articles.

The plaintiffs demand that the court prohibits the administration from using these provisions for the deportation of any of them based on their protected right to freedom of speech. The position of the advocates emphasizes that the U.S. Constitution should take precedence over federal laws when it comes to the protection of the right to freedom of speech.
