Utah Mammoth Files Lawsuit Against Hockey Equipment Manufacturer
- Utah Mammoth files a lawsuit against the manufacturer through the trademark with Mammoth Hockey
- The trademark arose due to potential trademark infringement
- Mammoth Hockey defends its brand in court
In Salt Lake City (AP) — Owners of the hockey team Utah Mammoth filed a lawsuit against the manufacturer of hockey equipment through the trademark regarding the brand name.
The lawsuit, filed in U.S. District Court in Utah, indicates that Mammoth and Mammoth Hockey LLC achieved trademark status regarding the brand.
"Utah Mammoth and the NHL firmly believe that they have the right to use the name Utah Mammoth according to federal and state legislation, and that our use will not infringe on any obligations or its business," said representatives of Smith Entertainment Group in a statement. "We have been pursuing these actions only after the retail breakdown of the position of the trademark."
The team announced a new name and logo in the spring following its first season in Utah. Previously, the team was called Utah Hockey Club during its first season after relocating from Arizona to Salt Lake City.
The company Mammoth Hockey, based in Oregon, sent a letter demanding to stop using the name immediately after the announcement of the new franchise name, asserting that potential clients may confuse the two brands, and fans of the superstars may not purchase its products. Both organizations must have logos in the form of a mammoth and related to the concepts "mammoth" and "hockey," along with the letter.
Mammoth Hockey was founded in 2014 and manufactures large sums for hockey equipment.
"Mammoth Hockey aims to actively protect the legal process initiated against Utah Mammoth of the National Hockey League, and to defend its trademark associated with hockey products, which it has been producing and selling for the last 10 years," said Mammoth Hockey spokesperson Eric Olsson in a comment for Deseret News.
