Wikipedia is challenging the online safety law in court
- Wikipedia may challenge the Online Safety Law in court.
- The Wikimedia Foundation considers the new requirements to be unacceptable for its operations.
- The court emphasized the importance of freedom of expression for Wikipedia.
Wikipedia received permission from the high court to challenge the Online Safety Law, which will classify it as a high-risk platform. The Wikimedia Foundation noted that in the case of such classification, it would restrict access to the site to comply with the new requirements.
Along with the new rules, which came into effect in February, some sites may be classified as "Category 1," which indicates the number of users and systems exchanging information. The Wikimedia Foundation asserts that these requirements could force them to implement verification for users who do not wish to undergo it or restrict the number of users from the United Kingdom.
Judge Johnson dismissed these objections but noted that the decision regarding Wikipedia's classification as a Category 1 service belongs to Ofcom. He also emphasized that any decision must be proportionate to avoid infringing on the right to freedom of expression.
Wikimedia believes that the new requirements could significantly impact their activities, as the site is non-profit and cannot afford large technological expenditures for implementing new obligations. Government ministers, in turn, believe that Wikipedia should comply with these requirements, as it is the responsible platform for their enforcement.
