Former Raiders coach Jon Gruden received a significant win in court on Monday. The Nevada Supreme Court upheld the ruling that Gruden's lawsuit against the NFL may be resolved in civil court, rather than in arbitration, which could have been designated by the NFL.
The court supported the arguments of Gruden's attorneys, stating that the NFL arbitration does not apply to him, especially at the moment of the emails' writing, which became the subject of the lawsuit, as he was not an employee of the league. Gruden also asserted that Commissioner Roger Goodell cannot designate arbitration, as it is an external dispute.
Gruden's attorney, Adam Hosmer-Henner, noted that the court's decision is a positive development not only for Gruden but also for all employees facing unjust arbitration processes. This ruling also helps restore Gruden's reputation and allows him to seek justice.
Gruden filed a lawsuit against the NFL, claiming that the league leaked his emails, in which there were racist, homophobic, and sexist remarks. These emails were sent in the 2010s, when Gruden was working as an analyst for ESPN, not as an NFL coach.
The emails became known in 2021 during a separate investigation of the Washington Football Club, when Gruden was already the coach of the Raiders. After the leak of the emails, Gruden filed a lawsuit in November 2021.
The NFL did not comment on the court's decision, but may file an appeal to the U.S. Supreme Court. If the Supreme Court declines to hear the case, the case may move to the evidence gathering stage, which opens the way for the discovery of details about the scandalous leaked emails.
